FAQ

The New Colossus Festival is a curated showcase of emerging independent artists from around the world. Unlike traditional festivals or club shows, the intention of a showcase is to find new partners and supporters in NYC and for some, the US. We welcome you to the 7th edition of this global gathering!

Are you paying the artists?

We do pay artists who are qualified to be paid in the US for example: US artists and artists with a visa.

The New Colossus Festival is a bona fide industry showcase event, established in 2019, where their audience is made up principally of music industry professionals, whose purpose in attending is not to be entertained, but rather to consider business relations with the artist in the future.

As such, it is our understanding that the artist[s] [does/do] not need not enter the U.S. with P or O visas, but may enter under the Visa Waiver Act, or using a B1 visa, as per 9 FAM 402.2-5(B)(1) (“to engage in commercial transactions, which do not involve gainful employment in the United States (such as a merchant who takes orders for goods manufactured abroad;” and to “ participate in .... professional, or business conventions, conferences, or seminars”) as articulated in Matter of Hira (11 I&N Dec. 824 (BIA 1965, 1966)."

The artist will receive no remuneration for their performance, and the purpose of the performance is to solicit future employment.
